Letter 1: GP Surgery

Request all GP notes, referral letters, correspondence from hospitals and specialists, medication records, care plans, and any CHC-related records.

Letter 2: NHS Trust / Hospital

Request inpatient and outpatient records, ward nursing notes, risk assessments, discharge documentation, and any CHC or Funded Nursing Care records.

Letter 3: Care Home or Care Provider

Request care plans, daily care records, incident reports, medication administration records (MAR charts), and all risk assessments.

Your rights under UK GDPR

  • Organisations must respond within one calendar month
  • There is no charge for a Subject Access Request (for reasonable requests)
  • You do not need to explain why you want the records
  • If the person cannot make the request themselves, a family member with LPA or appropriate authority can act on their behalf
  • If a request is refused or delayed, you can complain to the ICO at ico.org.uk

Why medical records matter for a CHC case

Without medical records, a CHC assessor is relying only on what they can observe in a short appointment. Records from GPs, hospitals, and care providers show the pattern of need over time — including incidents, clinical decisions, and the level of care actually provided.

Families who gather comprehensive records before the Checklist or MDT meeting are significantly better placed to challenge incorrect scoring or a negative decision.
